1. Service description
Bite Baba is a software-as-a-service platform for small Indian food businesses. It currently provides two separate business modes: Restaurant Mode and Store Mode.
Depending on the selected mode and plan, Bite Baba may provide:
- a public digital menu or catalogue;
- QR access and direct ordering;
- owner dashboards and operational tools;
- billing and document generation;
- customer records, staff access, and reporting;
- Store inventory, procurement, returns, and customer-credit features; and
- Restaurant ordering, table, and menu features.
Not every feature is available in every mode or on every plan.
2. Product boundaries
- One owner currently operates one Bite Baba business.
- The business type is selected as Restaurant or Store.
- Bite Baba currently does not provide mode switching.
- There is no combined Restaurant and Store tenant.
- There is no multi-business account or multi-branch management.
Bite Baba is not:
- a marketplace or delivery fleet;
- a payment gateway;
- a bank or lender;
- a complete accounting platform;
- a tax-return or GST filing service; or
- professional legal, accounting, or tax advice.
3. Eligibility
Owner and staff accounts should be created and used only by persons legally capable of entering into the relevant agreement and authorised to act for the business. The account holder is responsible for ensuring that submitted business information is accurate and lawful.
4. Account security
Users are responsible for:
- safeguarding account access;
- using accurate contact details;
- preventing unauthorised staff access;
- notifying Bite Baba of suspected compromise; and
- keeping staff permissions appropriate.
Users may not share credentials in a manner that defeats security or subscription controls.
5. Business mode
Once a business is created as a Restaurant or Store, the current product does not support switching that tenant to another type. Users should choose the correct mode during onboarding.
6. Plans
Bite Baba currently offers Free, Plus, and Pro plans.
Free is not a trial and does not expire merely because time passes.
Features, limits, and allowances vary by plan. The current Bite Baba website and Pricing page control the publicly advertised commercial plan information at the time of purchase or activation.
7. Paid subscriptions
Paid plans are generally activated for the stated subscription period after payment or approved activation. Bite Baba does not currently provide an integrated automatic subscription payment gateway or automatic recurring card billing.
Unless an alternative arrangement is expressly agreed, renewal requires a new payment or activation.
Where a limited-period launch price is offered, it applies to the first subscription year of that membership only. Renewal is charged at the regular price for the plan, not the launch price, unless Bite Baba expressly states otherwise.
8. Paid-plan expiry
When a normal Plus or Pro paid term expires:
- the business may fall back to currently available Free-plan capabilities;
- paid-only capabilities may become unavailable;
- business data is not intentionally deleted solely because the paid plan expired; and
- staff, settings, and history may remain stored even when access to paid capabilities is restricted.
Administrative suspension, legal or security restriction, and account termination are separate from normal paid-plan expiry.
9. Plan limits
Users must respect plan allowances and product limits. Bite Baba may prevent creation of additional items, staff accounts, or features where the applicable plan allowance is reached. Users must not attempt to bypass entitlement limits.
10. GST, tax, and billing
Bite Baba may provide:
- Simple Billing;
- GST invoice-generation workflows on eligible plans;
- tax calculations based on configured information; and
- printable or downloadable documents.
Users and businesses are solely responsible for:
- determining whether they are required to register for GST;
- deciding whether a GST invoice or another document is legally required;
- entering accurate GSTIN, state, HSN/SAC, and tax information;
- selecting the correct tax treatment;
- maintaining their own statutory records;
- filing returns and remitting taxes; and
- obtaining accountant or tax advice where required.
Bite Baba does not file GST returns and does not guarantee that use of the software by itself satisfies every tax or accounting obligation.
11. Payments between businesses and their customers
Bite Baba currently does not operate an integrated online payment gateway for customer payments. Where payment methods such as Cash, UPI, Card, Mixed, or Other appear in Bite Baba, they generally represent manual payment recording unless specifically stated otherwise.
Bite Baba does not hold customer funds as a payment intermediary.
12. Delivery
Bite Baba does not operate a delivery fleet.
Restaurant and Store owners remain responsible for:
- accepting and preparing orders;
- delivery arrangements and delivery personnel;
- delivery charges and timing; and
- disputes concerning fulfilment.
13. WhatsApp
Some workflows may:
- open WhatsApp using a pre-filled message;
- allow manual document sharing; or
- use messaging integrations where specifically enabled.
Opening WhatsApp does not guarantee that a message has been sent, delivered, or read.
14. Customer data
Businesses using Bite Baba are responsible for lawful handling of customer information they obtain through the service. Businesses must not use customer information for:
- unlawful spam or harassment;
- fraud;
- unauthorised sale of personal data;
- unlawful profiling; or
- other illegal purposes.
15. Customer credit and Udhaar
Where Store customer-credit functionality is available, Bite Baba records operational ledger information supplied through the Store workflow.
Bite Baba is not a bank, credit bureau, lender, or debt collector.
The Store remains responsible for deciding whether to extend credit and for resolving disputes with its customers.
16. Acceptable use
Users must not:
- use Bite Baba for illegal activity;
- submit fraudulent records or abuse customer data;
- upload malware or attack or probe the platform;
- attempt unauthorised tenant access;
- bypass permissions or subscription controls;
- reverse engineer the service except where applicable law expressly permits;
- interfere with availability or security;
- impersonate another person or business; or
- use Bite Baba to infringe third-party rights.
17. Business content
Businesses remain responsible for content they add, including menu or product information, prices, photos, trademarks, descriptions, tax details, contact details, and customer notes. They must have the necessary rights to use submitted content.
18. Intellectual property
ScaleVertex retains rights in Bite Baba software, code, branding, design, documentation, and platform materials, except for third-party materials. Users receive a limited, non-exclusive, non-transferable right to use Bite Baba during authorised access.
Businesses retain ownership of and responsibility for their own lawful business content and data, subject to the licences technically necessary for Bite Baba to host, process, and display it to provide the service.
19. Third-party services
Bite Baba may depend on or link to third parties such as hosting and cloud services, authentication or storage providers, WhatsApp or communications services, maps, and browser or platform services. Bite Baba cannot guarantee continuous operation of third-party systems.
20. Availability and changes
ScaleVertex may:
- maintain the service and fix bugs;
- improve the interface or features;
- change reasonable technical limits;
- discontinue unsafe or deprecated functionality; and
- make security changes.
Reasonable efforts should be made to avoid unnecessary disruption. Bite Baba does not guarantee uninterrupted or error-free service.
21. Suspension
Bite Baba may suspend or restrict access where reasonably necessary because of:
- a security risk or suspected fraud or abuse;
- a legal or regulatory requirement;
- a serious violation of these Terms;
- non-payment of an applicable paid service; or
- threats to other tenants or platform integrity.
Where reasonable, the user should be informed.
22. Termination
Users may stop using Bite Baba.
Account deletion or termination may be subject to:
- document retention;
- financial or tax records;
- dispute or legal holds;
- fraud or security records; and
- statutory requirements.
Termination may not result in immediate destruction of every record.
23. Disclaimers
To the maximum extent permitted by applicable law, Bite Baba is provided on an "as available" basis.
ScaleVertex does not guarantee:
- uninterrupted availability;
- that every feature will meet every business's needs;
- third-party service uptime;
- legal, tax, or accounting outcomes;
- customer sales or revenue;
- delivery performance or payment collection; or
- marketplace results.
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
24. Limitation of liability
To the maximum extent permitted by applicable law, ScaleVertex will not be liable for indirect, incidental, special, or consequential loss arising from use of Bite Baba, including lost profits, lost business opportunities, or third-party service failures.
For claims relating directly to a paid Bite Baba subscription, aggregate contractual liability will not exceed the amount actually paid to ScaleVertex for that Bite Baba subscription during the 12 months preceding the event giving rise to the claim, except where applicable law prohibits such limitation.
These limitations do not exclude fraud, wilful misconduct, or any liability that cannot legally be limited.
25. Indemnity
A business or user agrees to be responsible for claims or losses caused by its:
- unlawful use;
- unlawful business content;
- misuse of customer data;
- infringement of third-party rights;
- violation of law; or
- material breach of these Terms.
26. Refunds
Refunds and cancellations are governed by the separate Refund & Cancellation Policy.
27. Changes to these Terms
ScaleVertex may update these Terms for product changes, legal requirements, security, or commercial changes. Material changes should be posted with a revised Last Updated date. Where appropriate, additional notice may be given.
Continued use after an effective update constitutes acceptance to the extent permitted by law.
28. Governing law
These Terms are governed by the laws of India.
Any dispute will be subject to courts, tribunals, or consumer or dispute-resolution authorities having jurisdiction under applicable Indian law.
29. Severability
If a provision is unenforceable, the remainder remains effective to the extent legally possible.
